By accessing and using Aira (hiaira.ai) and related services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License and Service Access

Subject to your compliance with these Terms, Aira grants you a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use only. All subscription tiers (Spark, Memory, Vision, and Brain) are intended for individual, personal use and may not be used for commercial, business, or organizational purposes.

If you require commercial licensing or enterprise solutions, please contact us at say@hiaira.ai to discuss alternative arrangements.

Under this license, you may not:

  • Modifying or copying the materials
  • Using the materials for any commercial purpose or for any public display
  • Attempting to decompile or reverse engineer any software contained on Aira
  • Removing any copyright or other proprietary notations from the materials
  • Transferring the materials to another person or "mirroring" the materials on any other server
  • Using automated tools or bots to scrape, crawl, or extract data from the service

3. Disclaimer

The materials on Aira's website are provided on an 'as is' basis. Aira makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

4. Limitations of Liability

In no event shall Aira or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Aira, even if Aira or an authorized representative has been notified orally or in writing of the possibility of such damage.

5. Accuracy of Materials

The materials appearing on Aira's website could include technical, typographical, or photographic errors. Aira does not warrant that any of the materials on its website are accurate, complete, or current. Aira may make changes to the materials contained on its website at any time without notice.

6. Materials License

The license granted in this section is limited to the following: the license is a non-exclusive and non-transferable license to view, download and print pages or content from the Aira website, solely for personal use.

7. Limitations on Use

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from:

  • Harassing or causing distress or inconvenience to any person
  • Transmitting obscene or offensive content
  • Disrupting the normal flow of dialogue within Aira's website
  • Attempting to gain unauthorized access to Aira's systems
  • Using the Telegram Bot for illegal purposes
  • Overloading the service with requests designed to disrupt functionality

8. Termination of Use

Aira may terminate or suspend your account and right to use the service immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Service. Upon termination of your account:

  • Your right to use the service will immediately cease
  • You remain liable for all outstanding charges on your account
  • We may retain copies of your data as required by law

9. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the Republic of Poland, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

10. Dispute Resolution

Any disputes arising from or relating to these Terms of Service shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration under Polish law.

11. User Accounts and Authentication

To use Aira, you may need to authenticate through third-party platforms such as Telegram or other supported messengers. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of unauthorized access to your account

12. Subscription and Payment Terms

Aira offers multiple subscription tiers with different feature sets and usage limits:

  • Spark: Free tier with limited daily interactions
  • Memory: Paid subscription with increased interaction limits
  • Vision: Paid subscription with advanced features
  • Brain: Premium subscription with unlimited interactions

Payments are processed through Stripe. By providing payment information, you authorize Aira to charge the specified amount. Subscriptions automatically renew unless canceled. You can cancel your subscription at any time through your account settings.

13. Refund Policy and Right of Withdrawal

Right of Withdrawal (EU Consumer Law): As a consumer in the European Union, you have the right to withdraw from your purchase within 14 calendar days of the contract date, without providing a reason. However, this right does not apply if you have already started using the Service (made requests, stored content, or accessed features). Once the Service has been initiated at your request, you lose the right to withdraw.

Refund Requests: To request a refund (if eligible), contact us at say@hiaira.ai with your order details within 14 days of purchase. After 14 days or if you have actively used the service, refunds will not be issued unless required by applicable law.

Partial Use Refunds: If you wish to cancel mid-subscription, we will refund the prorated amount for unused days, provided the request is made within 30 days of the billing period start.

14. Data Processing and Third-Party Services

Aira integrates with various third-party services to provide core functionality:

  • AI Processing Services: Used for intelligent responses and content analysis
  • Messaging Platform APIs: Used to deliver messages and enable interaction
  • Payment Processors: Used for secure payment processing
  • Cloud Infrastructure: Used for reliable data storage and retrieval

These services are governed by their own terms of service and privacy policies. You acknowledge that Aira uses reputable third-party providers to deliver these services securely and reliably.

15. Intellectual Property Rights

Unless otherwise stated, Aira and/or its licensors own the intellectual property rights for all material on the website. All intellectual property rights are reserved. You may access this for personal use subject to restrictions set in these terms and conditions.

16. Modifications to Terms

Aira may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service. If you disagree with any changes, you should stop using the service and delete your account.
